Withdrawals and returns Policy
Pursuant to art. 52 of the legislative decree 6 September 2005 n. 206 ("Consumer Code"), you have the right to withdraw from the contract signed with the Seller without any penalty and without having to provide any reason, within fourteen (14) days from the day on which you received the products purchased on PUMA. srl.com. Pursuant to art. 54 of the Consumer Code, the right of withdrawal can be exercised using, at your choice, one of the following methods: i) use of the Return Form (compliant with the standard form pursuant to art. 49, paragraph 4 of the Consumer Code) which you find online in the Customer Service area to be completed in full to obtain the return number (the Seller will send you confirmation by e-mail of receipt of the withdrawal request sent via the Return Form); ii) use of this form (compliant with the standard form pursuant to art. 49, paragraph 4 of the Consumer Code) to be completed in full in all its fields; iii) sending the Seller another explicit declaration of your decision to withdraw from the contract, without prejudice, in such cases, that the burden of proving the correct and timely exercise of the right of withdrawal will remain with you.
The products to be returned must be delivered to the courier within fourteen (14) days from the date on which you communicated to the Seller your decision to withdraw from the contract.
The products can be returned by sending the package via the courier indicated by PUMA. SRL (Nexive) using the label that will be sent to you upon approval of your return, or via another shipping company. In some specific cases, duly reported in the Return Form, it will be possible to exchange the chosen item for another.
Pursuant to art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or personalized products or sealed goods that are not suitable for return for hygienic reasons or related to health protection and have been opened after delivery, such as, by way of example, products belonging to the "Cosmetics" category whose sealed packaging has been opened.
I. Conditions for exercising the right of withdrawal pursuant to art. 52 of the Consumer Code
The right of withdrawal is considered exercised correctly if the following conditions are fully respected:
to. within fourteen (14) days of receiving the products, you must correctly complete and send: the Return Form found in the Customer Service area or, alternatively, you can fill in and send this form or send another explicit declaration of your decision to withdraw from the contract also by registered letter to PUMA's address. SRL., Via Podgora, 11 - 20122 Milan, or by telegram, fax, to the number 051 6184287, to be confirmed, at your discretion;
b. the products must not have been used, worn, washed or damaged;
c. the identification tag must still be attached to the products with the disposable seal;
d. the products must be returned in their packaging; the package must be sealed as originally; if you want to return a kit, you must return all the items that make it up;
And. the returned products must be delivered to the chosen courier within fourteen (14) days from when you communicated to the Seller your decision to withdraw from the contract;
f. the products must not be damaged.
If you have complied with all the required conditions, PUMA. SRL pursuant to art. 56 of the Consumer Code will refund you in full the price of the products purchased, with only the return costs being your responsibility, i.e. those for returning them to PUMA. SRL of the products purchased, except PUMA. SRL has expressly exempted you from these costs at the time of purchase and on the further condition that you use the shipping company indicated in the Return Form. If you decide to use the courier chosen by PUMA. SRL for the shipment of the products purchased (Nexive) using the prepaid and pre-printed adhesive label that you will find inside your package, however, you will not have to pay the return costs yourself, PUMA will in fact do so. SRL to pay, on your behalf, the Nexive courier, withholding from the refund a sum equal to the cost previously incurred for the delivery of the purchased products to your home. If you decide to use a different shipping company, you will have to pay the return costs yourself.
You will be contacted if your return cannot be accepted because it does not comply with the conditions set out above in letters a), e) and f) of the previous paragraph. In this case, you can choose to have the products purchased back at your expense. In case you refuse this PUMA shipment. SRL reserves the right to withhold the products and the amount corresponding to the purchase price of the products.
You will also be contacted if your return cannot be accepted because it does not comply with the conditions set out above in letters b), c) and d) of the previous paragraph. In this case, you can choose whether to accept the reduction in the refund, which will be communicated to you, due to the decrease in value of the returned products, or whether to have the products purchased back at your expense. In case you refuse this PUMA shipment. SRL reserves the right to withhold the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.
II. Refund times and methods
In accordance with the art. 56, third paragraph of the Consumer Code, only after PUMA. SRL will have received your return and checked that all requirements have been met, you will receive an email confirming acceptance of the return and PUMA. SRL will proceed with a full refund, or, if the existence of a decrease in value of the returned products is found, you will receive an email in which you will be notified of the amount deducted by way of reduction of the refund and PUMA. SRL will proceed with the reimbursement of the amount due. Whatever payment method you use (credit/debit card, cash on delivery), the refund is activated by PUMA. SRL in the shortest time possible, and in any case within fourteen (14) days from the date on which it became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the conditions set out above.
The actual time for crediting or returning the sums paid by you for the purchase of the products depends on the payment methods used:
- purchase with credit/debit card: the time needed to view the refund depends on the institution that issued the card. We remind you that the value date of the credit is the same as the debit;
- purchase via PayPal: the refund will be made to your PayPal account and will be immediately visible. The actual credit card refund from your PayPal account depends on the card issuer.
- cash payment on delivery: the refund takes place on the current account indicated by you, therefore the reimbursement time depends on the correctness of the data you enter and the credit institution where you opened the account.
In the case of a gift, the sums will be refunded to the person who made the payment.
III. Conditions for exchanging products
In some specific cases, duly reported in the Return Form, as an alternative to exercising the right of withdrawal, you will have the possibility to exchange the products purchased with others, rather than obtaining a refund of the relevant price.
The exchange request will take place within the limits set out below:
to. Only those products purchased may be subject to exchange, for which this possibility will be expressly provided for in the Return Form;
b. you will be able to request the exchange of one or more products purchased only with products of the same model, having a different size and/or colour. In any case, the options available for exchange will be indicated in the Return Form;
c. you can request the exchange of one or more products purchased no later than fourteen (14) working days from the date of their delivery, by completing the Return Form, to be sent electronically to PUMA. SRL within the aforementioned deadline. The products to be exchanged must be delivered to the courier within fourteen (14) days from when you communicated to the Seller your decision to exchange the products.
d. you can only make one exchange request for each product purchased;
And. the products for which you request an exchange must be returned to PUMA. SRL in their original packaging, not used, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;
f. the products to be exchanged that are part of a single order must be sent to PUMA. SRL in a single shipment. PUMA. SRL, in fact, reserves the right not to accept products from the same order, sent for exchange at different times.
If all the conditions mentioned above are correctly respected, once the Return Form containing your exchange request has been completed and sent, PUMA. SRL will take care of the same replacement request by sending you a confirmation email to this end.
IV. Times and methods for obtaining the exchange
After PUMA. SRL will have received the products you intend to exchange and checked that all the above requirements have been respected, PUMA. SRL will check the actual availability of the products in the size and/or color you have selected in its warehouses.
In the event that the product or products selected for exchange are not available in its warehouses, PUMA. SRL will not be able to accept your exchange request and will therefore proceed to refund you the price of the product or products originally purchased and not replaceable, in accordance with the provisions of the Consumer Code and according to the methods set out in sections I and II of this information.
In the event that the product or products selected for exchange are available, PUMA. SRL will be able to accept your exchange request and will therefore send you an email confirming the shipment of the replacement products. In this case, the shipment will take place within thirty (30) days from the date on which PUMA. SRL will have become aware of your exchange request, once it has been verified that it has taken place in compliance with the conditions set out above in section III of this information. Shipping costs for replacement products will be borne by PUMA. SRL, which will choose the relevant carrier.
If the price of the product purchased is lower or higher than the price of the product selected for the exchange, you will not be granted any refund and/or charge for the difference.
You will be contacted if your exchange request cannot be accepted because it does not comply with the conditions set out above in section III of this information. In this case, you can choose to have the products you intended to exchange back at your own expense. In case you refuse this shipment, PUMA. SRL reserves the right to withhold the products and, should one of the hypotheses reported above in section I of this information also apply, it may also withhold the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.
The replacement product or products may be subject to subsequent return pursuant to art. 52 of the Consumer Code and in accordance with the provisions of the previous Sections I and II.
V. Product identification tag
All products offered for sale by PUMA. SRL are equipped with an identification tag fixed with a disposable seal, which constitutes an integral part of the goods. We invite you to try the product without removing the tag and its seal. We also remind you that, pursuant to art. 57, paragraph II, of the Consumer Code, you will be responsible for the decrease in the value of the products returned to the Seller, resulting from a use of the products other than that necessary to ascertain their nature, characteristics and functioning.
YOU. Nexive - RETURN OF PRODUCTS
Returns can be shipped via the Nexive courier indicated by PUMA. SRL, using the prepaid and pre-printed adhesive label that you will find inside your package. This method will allow PUMA. SRL to pay the shipping on your behalf and to check where your package is at any time. In order to organize the collection of the products you wish to return, contact Nexive. Alternatively, if you decide to use a shipping company other than the one indicated by PUMA to return the products. SRL, you will have to pay the return costs yourself and you will be responsible for any loss or damage to the products during transport.
VII. Consumer Code
These Conditions for the exercise of the right of withdrawal, forming an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code, Chapter I "Consumer rights in contracts".
